Introduction
These Terms and Conditions govern your use of elan-tech.net and any services provided by eLan Technology (registered in India). By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
Services
eLan Technology provides professional digital services including web design, web development, digital marketing, branding, mobile app development, and website maintenance. All projects are governed by a separate written proposal or contract agreed upon between eLan Technology and the client prior to commencement.
Intellectual Property
- All creative work, code, and deliverables produced by eLan Technology remain our intellectual property until full and final payment has been received.
- Upon receipt of full payment, the client receives full intellectual property ownership of the delivered work as specified in the project proposal.
- Our proprietary frameworks, internal tools, reusable components, and development processes remain the exclusive property of eLan Technology and are not transferred to the client.
Payment Terms
- A 50% advance payment is required before any project work commences.
- The remaining 50% balance is due upon project completion and before final files or credentials are delivered to the client.
- Late payments may attract interest at 2% per month on the outstanding amount.
- eLan Technology reserves the right to suspend or withhold services for accounts with overdue payments.
Project Scope & Changes
- Any changes to the agreed project scope after formal approval are subject to additional charges, assessed on a time-and-materials basis.
- All change requests must be submitted in writing (email or project management system) to be considered valid.
Warranties & Limitations of Liability
- eLan Technology warrants that all delivered work will be free from material defects for a period of 30 days following delivery and client sign-off.
- We are not liable for outages, failures, or disruptions caused by third-party services including hosting providers, domain registrars, payment gateways, or third-party APIs.
- Our total liability to you in connection with any specific service shall not exceed the total amount paid by you for that service.
- We are not liable for indirect, consequential, or incidental damages, including loss of business or revenue.
Confidentiality
Both parties agree to treat all project-related information as confidential and not to disclose it to unauthorised third parties. For full details of our confidentiality commitments, please see our NDA & Confidentiality Policy.
Termination
Either party may terminate a service agreement by providing 30 days written notice to the other party. Upon termination, the client is responsible for payment of all work completed up to and including the termination date, calculated on a pro-rata or milestone basis as applicable.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Nagpur, Maharashtra, India.
